These Terms of Service ("Terms") govern your purchase and use of Cappy, a Windows desktop application developed and sold by Tera28 Technologies, LLC ("we," "us," or "our"). By downloading or using Cappy, you agree to these Terms.
Upon purchasing a valid annual subscription, we grant you a personal, non-exclusive, non-transferable license to install and use Cappy on up to 3 devices you own or control, solely for your own lawful purposes. The license is per individual user and may not be shared across multiple people.
Your license is active for the duration of your paid subscription period. If your subscription lapses or is cancelled, your license to use the software terminates and you must stop using the application.
We offer a 14-day money-back guarantee. If you are unsatisfied for any reason within 14 days of your purchase date, contact us at support@getcappy.app and we will issue a full refund, no questions asked.
Refund requests made after 14 days from the purchase date are evaluated on a case-by-case basis at our discretion.
You may use Cappy to record your own screen activity and create documentation for personal, internal business, or commercial purposes. You may not:
Cappy's optional AI step-note feature requires your own OpenAI API key. You are solely responsible for your use of the OpenAI API, including compliance with OpenAI's Usage Policies and any associated costs. We are not affiliated with OpenAI and make no warranties regarding the availability or output of AI features.
An active subscription includes access to all software updates released during your subscription period. Updates are delivered automatically via the built-in updater. We reserve the right to modify, discontinue, or limit features of the application at any time.

Cappy and all associated content, design, code, and branding are the exclusive property of Tera28 Technologies, LLC and are protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the software.
Cappy is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the application will be error-free or uninterrupted.
To the maximum extent permitted by law, Tera28 Technologies, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Cappy, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid for your current subscription period.
We may suspend or terminate your license immediately and without notice if you violate these Terms. Upon termination, you must stop using the application. Provisions that by their nature should survive termination (including Sections 7, 8, 9, and 11) will survive.
These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in the United States.
We may update these Terms from time to time. We will notify active subscribers of material changes via email or in-app notice. Continued use of Cappy after changes take effect constitutes your acceptance of the revised Terms.
